HOW-TO GUIDES: Vacating a Default Judgment for Traffic Court

How to vacate (or set aside) a Default Judgment

(Mocion y Orden Para Anular un Default Judgment)

Did you receive a traffic citation and, for whatever reason, didn't appear (or know to appear) at the Traffic Court hearing? Or, was a Civil Complaint filed against you in the Superior Court and, for whatever reason, you didn't file (or know to file) an Answer? If so, the Traffic Court or the other party in the civil case has obtained a Default Judgment against you. If it was the Traffic Court, they probably sent the Default Judgment on to County Collections to collect payment, along with added fines.

You can reverse the Default Judgment against you by filing a Motion and Order to Vacate Default Judgment.
